01Identify the measure and the remedy
A challenge to an individual decision, a regulatory act, a refusal or a sanction may require different analysis. The first review should establish the issuing body, addressee, notification or publication history, standing and the applicable procedure. A grid operator's conduct is a separate question.
02Preserve the procedural record
The signed application, supporting documents, authority requests, responses and proof of communication matter. Assemble a dated chronology before selecting a remedy. Time limits and any preliminary steps must be checked against the particular measure and applicable legislation.
03Protect the project while the dispute continues
Assess the effect on licences, authorisations, guarantees, grid milestones, financing conditions and contractual obligations. Interim protection, where available, requires its own analysis and evidence. Bringing a challenge should not be assumed to suspend the contested measure.
04Define the litigation decision
A useful initial opinion separates admissibility, evidence, merits, possible relief, cost and commercial alternatives. We connect the legal route to the project timetable and consider whether clarification, a renewed application or negotiation can address part of the problem.
