01Identify the claim before choosing a procedure
An unpaid invoice, refundable deposit, restitution claim and damages claim may have different legal bases. Confirm the creditor, debtor, currency, amount, due date and any conditions to repayment. Identify whether the obligation is disputed and what the documents actually establish.
02Payment records and contractual defences
Review the contract, delivery or acceptance record, invoices, credits, payments and notices. Set-off, incomplete performance, defects or termination can change the analysis. A demand should reflect the documented amount and address material defences.
03Security, costs and enforceability
Examine guarantees, security, available assets, insolvency indicators and the practical cost of proceedings. The appropriate recovery route depends on the legal basis, evidence and debtor position. Settlement terms should deal with timing, security and the consequences of non-payment.
04Keep tax and grid refunds in their own workstreams
VAT refunds and tax repayment disputes belong in tax review. Grid cost recovery requires analysis of the relevant operator, cost category and regulatory or contractual basis. This commercial service does not assume a single reimbursement procedure applies to every claim.
